Humans couldn't have made them. That's beyond anything they're capable of, no matter the era.

'Shinigami,' Death Gods, possess these Notebooks of death and write down the names of humans within them.

If the Notebooks are meant for Shinigami, why are humans able to use them? How did they acquire them? What toll does it take, aside from the obvious?

Apparently they can be 'dropped' into the 'human world.' There are rules written in English upon the inner covers to dictate usage. As for the consequences for the user - the toll has yet to be definitively pinned down.
